Bratislava Legal Forum 2024

Bratislava, 17. september 2024

The jubilee 10th year of the international scientific conference "Bratislava Legal Forum 2024" was traditionally opened in the premises of the Faculty of Law of Comenius University in Bratislava (PraF UK) on Tuesday, 17 September 2024, with the plenary session of the conference with the primary topic: '"The Impact of European Law on National Legal Systems". Distinguished guests such as V4 Ministers of Justice, V4 Presidents of Supreme Courts and V4 Presidents of Bar Associations were invited to the plenary session.
In his opening speech, the Rector of Comenius University Marek Števček drew attention to the fact that in addition to climate change, we are also experiencing a change in the social climate, and the Minister of Foreign Affairs of the Slovak Republic Juraj Blanár appreciated the organisation of the conference. In conclusion, Minister Blanár expressed his wish that the Bratislava Legal Forum would become a legal conference of pan-European format. The attention was then turned to the opening ministerial panel of the conference, moderated by Dean Burda, whose guests were the Ministers of Justice of the Slovak Republic, Boris Susko, and Hungary, BenceTuzson, Deputy Minister of Justice of the Czech Republic, Vilém Anzenbacher, and Zuzanna Rudzińska-Bluszcz, Polish State Secretary of the Ministry of Justice. In their speeches, all of them assessed the functioning of EU legal system in their respective countries and commented on both the positives and negatives of the membership. Ms Rudzińska-Bluszcz stated that the EU no longer has the same shape as it had twenty years ago and pointed to several changes that took place during that period. She stated that there is enhanced cooperation between the states within the EU and there is also a harmonisation of legal systems, based on the European values.
Then, in the discussion, Dean Burda asked the participants the first question, "Where do you see areas of law that are over-regulated by the EU and where do you see areas that still require a certain degree of the European regulation in order to function properly and efficiently?" From the discussion, it became clear that it is necessary to examine the case law and, based on it, to identify which areas of legislation need to be regulated. At the same time, it is important to focus on consolidating national legislation in the areas of cultural and ethical issues, family law and judiciary, with the need for further regulation in the area of digitalisation and the online space. Participants also pointed out that the EU produces a large amount of legislation that creates a confusing network of the legal system. They concluded the topic by stating that EU legislation should be adapted to the 21st century and move forward by anticipating and predicting certain social phenomena in the future.
The discussion was followed by Dean Burda's statement that, unlike the Anglo-American system, the judicial law-making is not inherent in the continental system of law. He asked those present whether, in view of the fact that the EU had adopted many elements of the Anglo-American legal system, we were not thereby getting into a situation where judges were confusing their role and interpreting the law beyond the scope of their competences and whether there was a need to strengthen judicial law-making or to set up regulations in this respect. "The Court of Justice of the EU (CJEU) is indispensable in judicial drafting of EU law, but this should be based on the principles of subsidiarity and proportionality. The CJEU seeks to strengthen EU position, which comes at the expense of the identity of the member states," the Minister of Justice of the Slovak Republic said on the issue. The discussion focused on the expansion of the competences of the CJEU, which currently has various consequences, and this creates the need to reflect and rethink the entire EU legislative practice. Those present agreed that procedures of the CJEU are too long and that speed of decision-making is one of the fundamental features of justice.
At the end of the first panel, the relationship between national and EU law was discussed and the question of what the concept of the rule of law meant to the guests was also raised.

Seminar of Department of Theoretical Physics - Andreas Trautner (24.9.2024)

24.9.2024 at 14:00, Lecture room F1/125

Dr. Andreas Trautner (Max-Planck-Institut for Nuclear Physics in Heidelberg):
Electroweak Scale Hierarchy from Custodial Symmetry
Abstract:
I will introduce the idea of "Custodial Naturalness" to explain the origin of the electroweak hierarchy. Custodial Naturalness is based on classical scale invariance as well as an extension of the Standard Model (SM) scalar sector custodial symmetry to SO(6). This requires a single new complex scalar field charged under a new U(1) gauge symmetry which partially overlaps with B-L. Classical scale invariance and the high-scale scalar sector custodial symmetry are radiatively broken by quantum effects that generate a new intermediate scale by dimensional transmutation. The little hierarchy problem is solved because the Higgs boson arises as pseudo-Nambu-Goldstone boson of the spontaneously broken SO(6) custodial symmetry. The minimal setting has the same number of parameters as the SM and predicts new physics in the form of a heavy Z' as well as a light but close-to invisible dilaton.

The story of the Ischgl meteorite is finally solved

Almost 50 years of investigations of the EN241170 fireball and its possible connection with the...

The story of the Ischgl meteorite is finally solved A recently published paper in the Meteoritics and Planetary Science (MAPS) confirmed that Ischgl meteorite found in 1976 about 2 km northwest of the Ischgl town in Austrian Alps was associated with the fireball EN241170 (Mount Riffler), which was observed in Germany on the night of November 23/24, 1970, by 10 camera stations of the European Network. The meteorite was locked in the finder’s hands until 2008, when it was classified at the University of Innsbruck as an LL6 chondrite with very low weathering, implying a relatively short time between the meteorite fall and its retrieval. The reconstruction of the trajectory of the fireball was carried out for many years. Only recent investigations using the state-of-the-art Monte Carlo techniques reconstructed the fireball’s trajectory, its heliocentric orbit, pre-atmospheric mass, cosmic-ray exposure age, and determined the strewn field of fragments in agreement with the recovery location of the Ischgl meteorite. Radionuclide analyses of the Ischgl meteorite (708.1 g) were carried out already in 2013 in the Low-Background Gamma Spectrometry Laboratory of the Department of Nuclear Physics and Biophysics, which confirmed the presence of cosmogenic and primordial / radiogenic radionuclides. They helped to determine a pre-atmospheric radius of the Ischgl meteorite to be 25 ± 5 cm, representing a mass of 220 ± 50 kg (using its average density of 3.31 g/cm3), in agreement with the astronomical observations, confirming that the Ischgl meteorite originated from the EN241170 fireball. The results of the analysis of cosmogenic 26Al measured in the Ischgl meteorite, and their comparison with the Monte Carlo model of Leya and Masarik (MAPS, 2009), showed that its cosmic-ray exposure age is 1.7 ± 0.8 My. A comparison of 26Al data with the 22Ne/21Ne isotope ratio suggested a multistage scenario in the Ischgl history, expecting that it was first exposed to cosmic rays as a part of an asteroid, which was then disrupted by a collision with another body, and only after a few million years after that collision a fragment of the asteroid reached the Earth as the observed Ischgl meteorite. Such a scenario would allow the 26Al activity to enter into a new equilibrium, consistent with the observed meteorite size.
Almost 50 years of investigations of the EN241170 fireball and its possible connection with the fall of the Ischgl meteorite have finally been successful. Very good spatial and temporal agreement between the EN241170 meteorite fall and the subsequent Ischgl meteorite find, also supported by the presence of fresh fusion crust, low weathering, and data on stable and radioactive isotopes, suggest that the Ischgl meteorite originated from the fireball event that occurred on November 24, 1970 with the impact point near Mount Riffler. The comprehensive work presented in the MAPS paper was carried out by the Ischgl meteorite consortium consisting of 17 laboratories from 9 countries. This result places the Ischgl meteorite as a number three in the list of meteorites with observed fall and a known orbit (after the Příbram (1959) and Lost City (1970) meteorites), although presently there are already 55 meteorites with known orbit in the heliosphere. The long scientific story of the Ischgl meteorite after publishing in the MAPS paper also attracted worldwide media such as New York Times, Der Standard, World Today News, El Espectador, and many others. The research output has an Altmetric Attention Score of 78, which is a high-level measure of the quality and quantity of online attention that it has received. It is in the top 5% of all research outputs ever tracked by Altmetric.
