Protection of personal data

 

The Comenius University in Bratislava is a controller that processes personal data.

In Slovakia, the protection of personal data is regulated by Act No. 122/2013 Coll. on protection of personal data.

By 25 May 2018 the Regulation (EU) 2016/679 of the European Parliament and of the Council of 27 April 2016 on the protection of natural persons with regard to the processing of personal data and on the free movement of such data, and repealing Directive 95/46/EC (General Data Protection Regulation), known as the GDPR, shall apply in Slovakia.

Act No. 122/2013 Coll. on protection of personal data in its paragraph 28 regulates the rights of a person whose personal data constitute the subject of the processing or a person to whom the personal data relate. Such a person is called a data subject. Via a written application a data subject has the right to demand from the controller (The Comenius University) information on his/her personal data which constitute the subject of the processing or ask for their erasure or correction.

An instruction on the rights of a data subject

A data subject has a right to claim:

  1. confirmation whether his/her personal data are being processed,
  2. information about the state of processing of his/her personal data in the filing system in a generally intelligible form in the extent of an identification of a controller and a processor (if there is one); the purpose of processing of personal data; a list or an extent of personal data which constitute the subject of the processing; an instruction on voluntariness or on an obligation to provide personal data, time of validity of a consent or an information on a law which constitutes an obligation to provide personal data; third parties (if personal data are to be provided), a scope of recipients (if personal data are to be made available); a form of publication of personal data (if personal data are to be published); third countries (if personal data are to be transferred there),
  3. exact information, in a generally intelligible form, about the source from which the controller obtained his/her personal data for their processing,
  4. a list of his/her personal data, in a generally intelligible form, which constitute the subject of the processing,
  5. rectification or erasure of his/her incomplete, inaccurate or out of date personal data which constitute the subject of the processing,
  6. destruction of his/her personal data, if the purpose of their processing was fulfilled; if any official documents containing personal data constitute the subject of the processing, a data subject may request their returning;
  7. in a case of a breach of a law, destruction of his/her personal data which constitute the subject of the processing,
  8. blocking of his/her personal data due to the withdrawal of the consent for personal data processing before its expiration if controller processes personal data based on this consent.

The application mentioned hereabove or information on leak of personal data or other serious facts concerning processing of personal data by the Comenius University should be addressed to the data protection officer of the university
